This document outlines your rights to cancel contracts made with PDC Vehicles.
Please note, this policy specifically addresses the cancellation of PDC Vehicles' brokerage services and does not cover your rights to cancel with the finance provider or vehicle supplier.
Defined terms are as specified in our Terms of use.
1. Consumer Cancellation Rights
1.1 Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (“Regulations”), you have a 14-day cooling-off period for certain contracts for goods and services concluded at a distance or off-premises (such as online or over the phone). Where the Regulations apply, you can cancel the contract without penalty and without giving any reason.
1.2 The Regulations apply to contracts entered into by a “consumer” as defined by the Regulations: an individual acting for purposes wholly or mainly outside that individual’s trade, business, craft, or profession. Therefore, a sole trader or a partnership is not protected under the Regulations.
1.3 If you have entered into a contract with PDC Vehicles and you are a consumer, you will have explicitly requested us to commence services immediately on your behalf. By doing so, you waive the 14-day cooling-off period under The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (“Regulations”). This does not affect your right to cancel at any time, subject to the relevant cancellation fees.
1.4 However, if you have requested that we begin performing the services immediately and during the cancellation period, we reserve the right to charge you a cancellation fee.
1.5 The cancellation fee shall be proportionate to the services performed, compared to the full fees we would have received had the contract proceeded and we had provided our services in full. The cancellation fee will be satisfied by us retaining the arrangement fee and (if applicable) the order confirmation fee. The other fees we would have received if the contract had proceeded (which we would have received from the vehicle supplier but which would have been funded by you) will not be charged.
1.6 To cancel a contract, you need to inform us of your decision to cancel. You must include your full name, address, and details of the order you wish to cancel. The easiest way to do this is to email [email protected].
1.7 You may have a separate right to cancel the finance agreement, which is not governed by this cancellation policy. Please speak to your finance provider about this.
1.8 Depending on the status of the order at the point of cancellation, the vehicle supplier may also charge fees for cancellation. These are separate from PDC Vehicles' cancellation fee referred to in paragraph 1.5 above, and we will confirm the amount of the fees charged by the vehicle supplier when we receive your cancellation request.
2. Business Cancellation Rights
2.1 The 14-day cancellation right does not apply to transactions conducted by a business, including a sole trader, small partnership, large partnership, limited company, or limited liability partnership.
2.2 As a business customer, when you sign the order form, you request PDC Vehicles to commence providing the services. You accept that as a business customer, the 14-day cancellation right does not apply to you, and you shall be bound by this cancellation policy and our terms and conditions, excluding those provisions applicable to consumers.
2.3 In the event of cancellation by you, we reserve the right to charge you all or part of the arrangement fee, order confirmation fee, deposit, and/or initial payment (as applicable) as fees for our services.
2.4 Depending on the status of the order at the point of cancellation, the vehicle supplier may also charge fees for cancellation. These are separate from PDC Vehicles' cancellation fees referred to in paragraph 2.3 above, and we will confirm the amount of the fees charged by the vehicle supplier when we receive your cancellation request.
